HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21103 of 2007 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Revenue.

The present writ petition came to be filed seeking issuance of writ of mandamus with the following prayer: i) declaring G.O.Ms.No.585 Revenue (Registration-I) Department, dated 04.05.2005 as illegal, arbitrary and un-constitution;

ii) to direct the respondents to receive, register and deliver any conveyance deed executed by the petitioner in favour of any third party pertaining to plot No.73 an extent of 233 square yards in L.P.No.25/91 covered by Sy.No.59 of Pothina Mallayyapalem of Visakhapatna;

iii) to direct the respondents to cause denotification of her plot No.73 in Sy.No.59 of Pothina Mallayyapalem from the notification in G.O.Ms.No.585, Revenue (Registration-I) Department dated 04.05.2005 and thereby to receive, register and deliver conveyance deed executed by her in favour of any third party pertaining to the said plot.

Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that on 01.05.2009 this Court permitted the petitioner to make a representation to the District Collector within two weeks from the said date and the same was directed to be considered in the light of the report of M.R.O. Further the exercise was directed to be completed within a period of six weeks from the date of receipt of the

representation.

The counsel for the petitioner further submits that since the husband of the petitioner died she could not comply with the said condition. It is stated that great prejudice would be caused if the writ petition is dismissed for non-compliance of the said order. Having regard to the facts and circumstances of the case, the petitioner is directed to comply with the order dated 01.05.2009 by making a representation to the District Collector within a period of two weeks from today, in which event the same shall be considered in the light of the report of M.R.O. referred to in the order dated 01.05.2009. The said exercise shall be completed within a period of six weeks from the date of representation and a copy of the order passed by the Collector shall be communicated to the petitioner.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 22.01.2016 Note: Issue C.C. by Monday.
