This writ petition is filed under Article 226 of the Constitution of India for the following relief :
"To declare the in action of the respondents in not considering the application made for parole on behalf of petitioner's father Sri Chintha Srinivasa Rao [C.T.No.3120] and his junior paternal uncle Sri Chintha Krishna [C.T.No.3431] as illegal,. Arbitrary, against the principles of natural justice and violation of Article 14, 21 of the Constitution of India and violation of the A.P. Prison Rules and consequently to direct the respondents to grant emergency parole to the above two persons and to pass such other suitable orders as this court deems fit and proper in the circumstances of the case."
2. Heard Sri G.Buchaiah Goud, learned counsel for the petitioner and the learned Government Pleader for Home for the respondents. 3.
When the matter is called today, a memo bearing No.12677/Paroles/2015, dated 30/9/2015 issued by the Principal Secretary to Government, Home [Paroles and HRC] Department, has been placed on record by the learned Government Pleader for Home.
4 . Memo.No. 12677/Paroles/2015, Government of Andhra Pradesh, Home [Paroles and HRC] Department, dated 30/.9/2015 reads as under: Government hereby grant Escort Parole to Chintha Srinivasa Rao s/o. Venkateswara Rao, CT.No.3120 and Chintha Krishna @ Bandi Krishna s/o Venkateswasra Rao, CT.No. 3431, Central Prison, Rajahmundry, resident of Surayanarayanapuram, 35th ward, Bhimavaram village and Mandal, West Godavari district for a period of five [5] days at Government cost, subject to the condition that they have to submit B.P.L. Certificate issued by the concerned Tahsildar at the time of their release, other wise at convict's cost, so as to enable them to attend their brother's death ceremony on 01/10/2015 at Surayanarayanapuram, 35th ward, Bhimavaram village and Mandal, West Godavari district, and also subject to the condition that they are not under trial prisoners and not required in any other court cases.
2. The Superintendent of Police, Rajahmundry is requested to provide proper escort to the convicts and subject to the above said condition ensure that they brought back to prison after expiry of the said escort parole period.

5. In view of the above, nothing survives for adjudication in this writ petition. The writ petition is closed. No costs.
6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
