THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.37877 OF 2015 ORDER:

The petitioner herein filed I.D.No.278 of 2007 before the Industrial Tribunal-cum-Labour Court, Anantapur, assailing the order of removal, dated 05-02-2007 passed by the respondent and direct the respondent to reinstate the petitioner with continuity of service, back-wages and all other attendant benefits. The Tribunal, vide order, dated 28-01-2011 directed the respondent to reinstate the petitioner into service with continuity of service, attendant benefits, but without back-wages on the principle of 'no work no pay'.

2. The petitioner instituted the present writ petition contending that in spite of several representations, so far, the award is not fully implemented and consequential benefits are not granted and pay fixation of the petitioner is not made.

3. Learned counsel appearing for the petitioner submits that the petitioner submitted a representation for compliance of the order passed by the Tribunal for fixation of pay and payment of emoluments due, but, so far no orders are passed on the representation. However, copies of the representations are not filed.

4. Having regard to the facts of the case and as agreed by both counsel, the writ petition is disposed of granting liberty to the petitioner to make a detailed representation to the 2nd respondent herein-Regional Manager, APSRTC, Chittoor Region and when such representation is made, the 2nd respondent herein shall consider the request of the petitioner and pass appropriate orders as warranted within a period of four weeks from the date of receipt of a copy of this order. If it is found that the petitioner is entitled to the benefits as claimed, all such benefits shall be released to the petitioner within four weeks thereafter. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
