THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.3029 OF 2020 ORDER:
The present Writ Petition is filed questioning the inaction of respondent Nos.2 and 3 in not taking any action on the complaints of the petitioner dated 16.01.2020 and not even registering an FIR or causing any enquiry, as being illegal and arbitrary. Heard Sri V. Brahmaiah Chowdary, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 11.02.2020, submits that on receipt of the petition, the 3rd respondent authority made a G.D. entry, and a notice under Section 91 Cr.P.C. was issued to the petitioner on 17.01.2020 with a request to furnish related copies of land in Sy. No.679 (old), 519 (new) of Prashanth Nagar, Waddepally village, so as to enable the 3rd respondent to take further action on her complaint. It is stated that till date, the petitioner has not furnished the documents pursuant to the notice issued and upon the petitioner furnishing the above said documents, necessary action will be taken on the complaint.
Learned Counsel for the petitioner submits that the petitioner is not in receipt of any notice dated 17.01.2020, however, a copy of the said notice as sent to the petitioner has handed over today in the court to the Counsel for the petitioner.
Learned Counsel for the petitioner submits that the petitioner would furnish the documents as noted in the said notice to the 3rd respondent.
Recording the said submissions made on either side, upon the petitioner furnishing the documents as noted in the notice dated 17.01.2020 in furtherance of the complaint made, the respondent authorities shall take necessary action in accordance with law.
Accordingly, the Writ Petition is closed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
