2019-12-16P.Keshava Rao1 pages

THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.13277 of 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondents 1 to 3. 2.

The prayer sought in the writ petition is as under: "Therefore it is prayed that this Hon'ble Court may be pleased to issue a writ, order or directions more particularly Writ of Mandamus, declare the action of the Respondents in not completing the investigation by arresting the Accused by issuing the lookout and red corner notice against the Accused in connection with Cr.No.15/2014 on the file of PS Kushaiguda is arbitrary, illegal and against to the letter and spirit of constitution of India and consequently direct the Respondents to issue the lookout and red corner notice against the Accused in connection with Cr.No.15/2014 on the file of PS Kushaiguda, Cyberabad, and to expedite the investigation of said case and pass such other order or orders as the Hon'ble Court deems fit and proper in the interests of justice." 3.

Learned Government Pleader appearing for respondents 1 to 3 brought to the notice of this Court that pursuant to registration of Crime/FIR No.15 of 2014, investigation was completed and a charge sheet was filed. However, by virtue of the compromise entered into on 23.08.2014 before the III Metropolitan Magistrate, Ranga Reddy District at L.B.Nagar, no further cause would survive in the writ petition. 4.

Having regard to the submission made by both the counsel, particularly since the charge sheet is also filed in Crime/FIR No.15 of 2014, this Court is of the opinion that no further cause would survive in the writ petition.

5.

Accordingly, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTI CE P.KESHAVA RAO Date:16.12.2019 PGS
