HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO Writ Petition No.2264 of 2006 ORDER:

This Writ Petition is filed to issue a Mandamus declaring G.O.Ms.No.10, Animal Husbandry, Dairy Development and Fisheries (Dairy.II) Department, dated 04.02.2006, the consequential proceedings of respondent No.2, vide Rc.No.60/2006.P1, dated 04.02.2006 and the proceedings of respondent No.3, vide Rc.No.36/2006/A2, dated 04.02.2006, as arbitrary and illegal.

G.O.Ms.No.10, dated 04.02.2006, authorised the District Collectors, under Section-32(7) of the Andhra Pradesh CoOperative Societies Act, 1964 to appoint officials as Persons-incharge to manage the affairs of all the Primary Milk Producers Co-Operative Societies till fresh elections or until further orders, whichever is earlier. The consequential order was passed by respondent No.2 on 04.02.2006 appointing the District Collector, Visakhapatnam as Person-in-charge of the petitioner for a period of six months from the date of the said order or until further orders, whichever is earlier. The said order was suspended by this Court by order, dated 07.2.2006. The period specified in the order of respondent No.2 is over. However, the

ARLR, J WP.No.2264 of 2006 Dt:08.12.2016 learned counsel for the petitioner submits that in view of the decision of the Supreme Court in Andhra Pradesh Dairy Development Corporation Federation Vs. B.Narasimha Reddy and Others1, no further orders are required in the present Writ Petition.

Recording the said submission and in view of the lapse of the period specified in the order of respondent No.2, the Writ Petition is dismissed as infructuous. No costs. As a sequel to dismissal of the Writ Petition, the Miscellaneous Petitions, if any, pending are dismissed as infructuous.
