ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 to 3 in Crime No.29of 2026 before the

Jagadgirigutta Police Station, Cyberabad Commissioenrate, registered for the offences punishable under Sections 333, 118(2), 324 (4) read with 3(5) of BNS.

The brief facts of the case are that on 06.01.2026 at about 9:00 a.m., the complainant, Sri Thatha Vijay Kumar, Principal of Nisse Swathi High School at Jagadgirigutta, alleged that while he was in his office after opening the school, certain persons, namely Nagesh, Naresh, Mruthyunjai, and others, unlawfully entered the premises, assaulted him with hands, legs, and a cable wire on the allegation that he had kissed a girl student, and caused bleeding injuries to his right eye and other parts of his body. It was further alleged that they damaged school property, including an almirah, computer, and laptop. Based on his complaint, a case was registered in Crime No. 29/2026 under Sections 333, 118(1), 324(4) read with 3(5) of the BNS. During the course of investigation, the section 118(1) was altered to 118(2) basing on the injury certificate.

Heard Sri G. Prem Kumar, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra

Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent and that the allegations made against them are false. He contended that there was no necessity or intention on the part of the petitioners to commit the alleged offences. He further submitted that the de facto complainant had been misbehaving with the students and that the petitioners only questioned him in that regard. He contended that the petitioners are ready to cooperate with the investigation and that no other criminal cases are pending against them. Therefore, he prayed the Court to grant prearrest bail to the petitioners by allowing this Criminal Petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, stating that the injuries sustained are grievous in nature and that there are serious allegations against the petitioners. He further submitted that the investigation is still pending and that, at this stage, granting pre-arrest bail to the

petitioners would not be appropriate. Therefore, he prayed the Court to dismiss the Criminal Petition.

In light of the submissions made by both sides and upon perusal of the material available on record, it appears that the petitioners are arrayed as accused Nos.1 to 3. The main allegation against them is that, on the ground that the de facto complainant was misbehaving with the students, they questioned and assaulted him. Considering the facts and circumstances of the case, this Court deems it fit to grant prearrest bail to the petitioners, subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Jagadgirigutta Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section

482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
