THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.29251 of 2011 ORDER:

The grievance of the petitioner - Mosque was that the police authorities were interfering with its affairs and management and claiming that its property was the property of the Reserve Police Line, Eluru.

The Inspector of Police, Eluru Town Circle, West Godavari District, filed a counter-affidavit stating that the dispute of the petitioner related to a Wakf institution and that the police authorities had nothing to do with the same. He further stated that the police authorities never interfered with the property nor summoned the committee members of the petitioner - Mosque to the police station. The Inspector of Police stated that no case had been registered on the file of Eluru Police Station and therefore, there was no necessity for the police authorities to interfere with the affairs and management of the petitioner - Mosque.

No reply-affidavit has been filed rebutting the aforestated counter-affidavit averments.

In the light of the stand taken by the police authorities, it is clear that there is no interference by them with the affairs and management of the petitioner - Mosque.

Recording the said stand, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
