ORDER

The present criminal revision case is directed against the docket order dated 13.10.2015 passed in Crl.M.P.(SR) No.2507 of 2015 in C.C.No.64 of 2013 by the learned Special Judicial Magistrate of First Class (Excise), Karimnagar.

2. Heard and perused the material on record.

3. The petitioner/A1 is involved in C.C.No.64 of 2013 on the file of the Special Judicial Magistrate of First Class (Excise) at Karimnagar, registered for the offences punishable under Section 498-A IPC and under Section 4 of Dowry Prohibition Act. While granting bail to the petitioner, the trial Court imposed a condition on the petitioner to deposit his passport in the Court and he shall not leave India without prior permission of the Court.

Subsequently, the petitioner filed the impugned application seeking to return his original passport. By the order impugned, the trial Court rejected the said application. Aggrieved by the same, the present revision is filed.

4. It is represented that the investigation is completed and the charge sheet has been filed. Since the identity of the petitioner is not in dispute and his mother is ready and willing to represent him before the trial Court, this Criminal Revision Case is disposed of with the following direction;

The trial Court is directed to return the passport to the

petitioner on his executing a bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like sum to its satisfaction and also on his undertaking to appear before the trial Court on the date of his examination under Section 313 Cr.P.C. and pronouncement of judgment.

Miscellaneous Petitions, if any, pending in this revision shall stand closed.
