HON'BLE DR. JUSTICE B. SIVA SANKARA RAO I.A.Nos.2 & 3 of 2018 IN/AND Crl.P.No.786 of 2018 ORDER:

The petitioners/accused Nos.1 to 7 and the 1st respondentdefacto complainant are present along with their respective counsels.

I.A.Nos.2 & 3 of 2018 are filed by them to compound the offences against the accused in S.C.No.129 of 2017 on the file of Senior Civil Judge-cum-Assistant Sessions Judge, Vikarabad, Ranga Reddy District, which is outcome of crime No.137 of 2016 of Shabad Police Station, registered for the offences punishable under Sections 376, 420, 417 r/w 109 IPC by stating that they settled the matter outside the Court amicably to purchase peace and terms of the compromise was also appended.

Having regard to the fact that the defacto complainant-victim and A.1 got married and now she is pregnant and the victim along with her parents and accused present stating in the interest of the victim and child in the womb, this Court feels it just to compound the offence under Section 376 IPC even though it is noncompoundable. In view of the compromise between the parties, I.A.Nos.2 & 3 of 2018 are allowed by compounding the offences. Consequently, the Criminal Petition is allowed and the proceedings against the accused in S.C.No.129 of 2017 on the file of Senior Civil Judgecum-Assistant Sessions Judge, Vikarabad, Ranga Reddy District, are hereby quashed, accused is acquitted and the bail bonds of the

Dr.SSRB,J accused, if any, stands cancelled. Pending miscellaneous petitions, if any, shall stand closed.
