HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 679 OF 2015 AND WRIT PETITION No. 20104 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Sri A.S. Vasudevan, learned counsel for the respondent - institution/college and writ petitioners in W.P.No.20104 of 2015, fairly states that the college/institution did not furnish undertaking as per the order of this Court, dated 23.09.2015, and to protect the interests of students, writ petition itself may be allowed to be withdrawn with directions to accommodate already admitted students under convener quota and the management quota in B.Tech-CSE, B.Tech-ECE, B.TechEEE and B.Tech-Civil Engineering courses in other recognized colleges. Learned Advocate General appearing for the appellant University submits that the students i.
e., 37 students of B.Tech-CSE, 6 students of B.Tech-ECE, 1 student of B.Tech-EEE and 10 students of B.Tech-Civil Engineering, admitted under convener quota and 17 students admitted under management quota i.e., 11 students of B.Tech-CSE, 1 student of B.Tech-ECE, 1 student of B.Tech-EEE and 4 students of B.Tech-Civil Engineering shall be accommodated/transferred to other recognized colleges within a period of two weeks from today. His statement is recorded and accepted.
The students admitted in the aforesaid four courses under
convener quota are directed to approach the Convener within a period of ten days from today for accommodating/transferring these students to recognized colleges.
The Convener shall take steps to accommodate/transfer these students in recognized college within two weeks therefrom. Insofar as the students, who are admitted under management quota, are directed to approach the Registrar, JNTU, within a period of one week from today for transfer of their admission to other colleges.
The Registrar, JNTU, is directed to accommodate the aforementioned 17 students in recognized colleges within a period of two weeks therefrom.
With these directions, W.P.No.20104 of 2015 is disposed of as withdrawn and as a consequence thereof, W.A.No.679 of 2015 is also disposed of. It is needless to mention that the order impugned in the writ appeal renders ineffective insofar as the petitioners' institution/college in W.P.No.20104 of 2015 is concerned. We also make it clear that the writ petitioners' institution/college shall refund the fees paid by the students to be transferred as aforementioned within a period of one week from today. It is further made clear that the students from the writ petitioners' institution/college shall be accommodated in other recognized institutions/colleges, subject to fee adjustment, if any.
