THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.1311 of 2025 ORDER:

The present Criminal Petition is filed praying this Court to enlarge the petitioner who is arrayed as accused No.2 in Crime No.92 of 2024 of Economic Offences Wing (EOW), Cyberabad, Ranga Reddy District, on bail. The offences registered against the petitioner are under Sections 316 (2), 318 (4) of Bharatiya Nyaya Sanhita, 2023 and under Section 5 of Telangana Protection of Depositors of Financial Establishment Act, 1999. 2.

The case of the prosecution is that on 10.12.2024 the complainant lodged a complaint before police stating that M/s.Gayathri Infra Developers and its Managing Partners, M. Chandra Reddy and Smt K.Aruna cheated him under the guise of purchase of buy back open plot to an extent of 1600 Sq yards by joint development of land to an extent of Ac.1.02.5 guntas and he purchased the same from the accused by paying huge amount to a tune of Rs.1.40 Crores, entered into MOU and thereafter, the

- 2 - accused failed to comply with the terms and did not respond to the phone calls, thereby the complainant came to know that he was cheated by the accused. As such, requested the police to take necessary action. Basing on the complaint, the police registered the case against the accused for the above offences. 3.

Heard Sri V.Naveen Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the complainant has purchased the property and petitioner herein has already registered land in the name of complainant and he is taking steps for development of the said land. In the meanwhile, the complainant lodged complaint before the police and there is no intention to cheat the complainant, by this petitioner. Petitioner is in jail from 20.12.2024 and material part of investigation is completed. Further, police custody of this petitioner is also completed. As such, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that huge amount is involved in this case and it has to be recovered. As such, prayed this Court to dismiss this petition.

Having regard to the submissions made by both the counsel and the material on record, petitioner is in jail from 20.12.2024 and material part of investigation is completed. Considering the said circumstances, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Principal Junior Civil Judgecum-Metropolitan Magistrate, Ranga Reddy District at L.B.Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
