HONOURABLE JUSTICE G. SRI DEVI I.A.NO.2 OF 2019 IN/AND CRIMINAL REVISION CASE NO.139 OF 2019 COMMON ORDER:
The petitioner, who is respondent in F.C.M.C.No.18 of 2015 on the file of the Family Court-cum-Additional Distict & Sessions Judge at Karimnagar, filed this Criminal Revision Case under Sections 397 and 401 of the Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in the above case registered under Section 125 Cr.P.C.
During pendency of the Criminal Revision Case, I.A.No.2 of 2019 came to be filed by the second respondent to record the compromise and to compound the offence. Along with the petition, a joint memo came to be filed, inter alia, stating that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the compromise. The said joint memo has been supported by the affidavit of the second respondent. Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioner/respondent. Further, in the compromise memo it is stated that the second respondent received Rs.8,00,000/- by way of two Demand Drafts bearing Nos.670123 and 670124 dated 11.10.2019 for Rs.3,00,000/- and
Rs.5,00,000/- respectively drawn on the State Bank of India, Tower Circle Branch, Karimnagar, towards permanent alimony and Rs.8,000/- in cash towards arrears of maintenance @ Rs.4,000/- per month for two months from the petitioner/respondent. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.No.2 of 2019 is ordered.
Accordingly, the Criminal Revision Case is allowed in terms of compromise, and the proceedings in F.C.M.C.No.18 of 2015 on the file of the Family Court-cum-Additional Distict & Sessions Judge at Karimnagar, against the petitioner/respondent are hereby quashed.
Miscellaneous applications, if any, pending, shall stand closed.
