Heard the learned counsel for the petitioner/Accused and the learned Public Prosecutor.
2. The present Criminal Petition came to be filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, by the petitioner/accused seeking enlargement on bail in Crime No.199 of 2015 of Narasapuram (T) Police Station, West Godavari District, registered for the offence punishable under Section 420 IPC and Sections 3 and 4 of Private Chits and Money Circulation Schemes (Banning Act), 1978.
3. Learned counsel for the petitioner submits that the offences alleged against the petitioner are false and a false case has been foisted against him.
4. Even as per the First Information Report only a sum of Rs.9,000/- was alleged to have been collected by the police. It is the case of the petitioner that all the five witnesses examined by the police do not speak about his involvement in the offence.
5. Learned Public Prosecutor opposed the same contending that investigation is still pending and huge amount has been misappropriated by the petitioner.
6. Since the investigation is pending, I am not inclined to grant bail to the petitioner at this stage. However, liberty is given to the petitioner to move an application for bail immediately after filing of the charge sheet.
7. With the above observation, the Criminal Petition is dismissed.
