Heard learned counsel for the petitioner and learned Government Pleader for Home and perused the prayer in the writ petition with supporting affidavit and other material on record. 2.

The prayer in the writ petition reads as follows: ".......to issue an appropriate writ, order or direction more particularly one in the nature of Mandamus by declaring the action of the 3rd Respondent in not releasing the petitioner's vehicle Auto Rickshaw bearing No.AP 15 T 3084 involved in Cr.No.136 of 2017 Dt.06.10.2017 as illegal, arbitrary and against the principles of natural justice and pass such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

In view of the enabling statutory provision to approach the Deputy Commissioner concerned, by filing application for getting release of the vehicle, if any, there is nothing to entertain the writ petition and keep it pending with any interim direction, but for to dispose of, enabling the petitioner to approach the Deputy Commissioner by filing application availing the statutory provision and in such event, the Deputy Commissioner shall dispose of the application within three weeks thereafter.

With the above direction, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs.
