HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2214 of 2018 ORAL ORDER: (Per Suresh Kumar Kait, J) Vide the present petition, petitioner has assailed order dated 14.11.2017 passed in O.A.No.2696 of 2017 by the Andhra Pradesh Administrative Tribunal, Hyderabad.
The aforesaid O.A., was dismissed by the learned Tribunal by recording that the petitioner herein does not deserve for consideration even for ad hoc promotion since he was involved in an offence involving moral turpitude relating to a scam in which Rs.4.50 crores is stated to have been misappropriated by him along with others; thus, his case cannot be examined in terms of G.O.Ms.No.257 General Administration (Ser.C) Department dated 10.06.1999. The learned Govt. Pleader appearing on behalf of the State, on advance notice, submits that G.O.Ms.No.257 dated 10.06.1999, covers all types of cases and even the case of the petitioner herein also falls under the said G.O., and accordingly the case of the petitioner herein will be treated in terms thereof. In view of the submission made by the learned Govt. Pleader, we, hereby, set aside the order dated 14.11.2017 passed by the learned Tribunal in O.A.No.2696 of 2017. Consequently, respondents are directed to consider the case of the petitioner in terms of G.O.Ms.No.257 General Administration (Ser.C) Department dated 10.06.1999.
Petition is accordingly disposed of. No order as to costs. As a sequel, miscellaneous petitions if any pending in the petition stand closed.
