HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22843 OF 2016 ORDER:

The case of the petitioner is that his father was assigned land admeasuring Ac.0.54 cents in Survey No.288/3A at Pathapadu Village, Krishna District by the Tahsildar Vijayawada vide proceedings dated 29.04.1977. After the death of petitioner's father, the petitioner got patta in his name and cultivating the same. While so, the 3rd respondent gave information that the aforesaid lands are included in the prohibitory list and classified the subject land as AWD land under Section 22A of the Registration Act. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

It is to be seen that admittedly even according to the petitioner, petitioner's father was assigned lands. As long as the petitioner's land is an assigned land he cannot have any grievance for including the same in prohibitory list, since it is not the case of the petitioner that there is no condition of prohibition of alienation in the Patta granted to the petitioner. Further, the counsel for the petitioner has not brought to my notice any infirmity in the action of the 3rd respondent in keeping the above lands originally assigned to the father of the petitioner in the prohibitory list under Section 22A of the Registration Act.

In view of the same, I do not see any merits in the writ petition. Accordingly, the writ petition is dismissed. No order as to

costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
