HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1064 of 2020 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., challenging the order dated 06.01.2020 passed in Crl.M.P.No.3462 of 2019 in C.C.No.160 of 2018 on the file of XIII Additional Chief Metropolitan Magistrate (Mahila Court), Hyderabad. 2.

During pendency of trial, the petitioner/A1 filed impugned application seeking permission of the Court to go to abroad. By the order impugned, the trial Court dismissed the said petition on the ground that the case is posted for framing of charges. 3.

Heard learned counsel for the petitioner/A1 and learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Learned counsel for the petitioner/A1 submits that as the petitioner is working in Bin Ladin group of companies at Saudi Arabia, he intends to go to abroad to attend his employment on or before 09.03.2020 and to return back to India to appear before the Court on 23.03.2020. He further submits that the petitioner is having passport bearing No.P0059716 issued on 03.10.2016 at Riyadh Indian Embassy, K.S.A. He further submits that the Court below failed to consider the employment of the petitioner at Saudi Arabia and his credentials. He also submits that the petitioner is ready to abide by any condition imposed by this Court.

Learned Additional Public Prosecutor submits that the trial Court has rightly dismissed the petition as the case is posted to 23.03.2020

for framing of charges and there is no need to interfere with by this Court.

Having regard to the facts and circumstances and in the light of the submissions made by the petitioner/A1 and in view of the nature of offences alleged to have committed by him, the petitioner/A1 is permitted to leave India and to go to Saudi Arabia to attend his duties on or before 09.03.2020 and he shall personally present before the trial Court on the date of framing of charges. Further, the petitioner/A1 shall file an affidavit of undertaking before the trial Court that he shall personally present before the trial Court on the date of framing of charges.

With the aforesaid direction, the Criminal Petition is disposed of. 5.

As a sequel thereto, miscellaneous applications, if any, pending in this criminal petition shall stand closed. ______________ G. SRI DEVI, J 3rd March, 2020.
