THE HONOURABLE SRI JUSTICE K.LAKSHMAN WRIT PETITION No.4033 OF 2023 ORDER:

Heard learned counsel for the petitioner and learned Asst.Govt.Pleader for Revenue. Perused the record.

2. The petitioner's mother late Smt. Donthi Balamma has filed an application seeking issuance of Occupancy Rights Certificate in respect of land admeasuring Ac.1-26guntas in Sy.No.144, Ac.1-23guntas in Sy.No.145, Ac.1-37guntas in Sy.No.146, Ac.1-20guntas in Sy.No.147, Ac.1-31 guntas in Sy.No.148, Ac.1-33 guntas in Sy.No.149, Ac.1-01gutnas in Sy.No.150, Ac.13-00guntas in Sy.No.151, Ac.1.28guntas in Sy.No.152, Ac.2.05guntas in Sy.No.153, Ac.1-18guntas in Sy.No.154, Ac.7-22guntas in Sy.No.155, Ac.0.32 guntas in Sy.No.156, Ac.2-04guntas in Sy.No.157, Ac.6-23guntas in Sy.No.158, total admeasuring Ac.46-23 guntas situated at Mallapur Village, Uppal Mandal, Medchal-Malkajgiri District, with 2nd respondent. On filing of said application, 2nd respondent sought field report from 3rd respondent, who in turn, had submitted the said report on 17.06.2019 itself. Thereafter 2nd respondent did not conclude the enquiry. During the pendency of the said application, the petitioner's

mother died on 10.05.2021. Therefore, the petitioner herein has filed Interlocutory Application in the said application requesting 2nd respondent to bring him on record and complete the enquiry in the aforesaid application in File No.J/1332/2018. 2nd respondent is not considering the said application and not completing enquiry in the aforesaid application. Therefore, the present application.

3. Whereas, learned Asst.Govt.Pleader for revenue, on instructions, would submit that 2nd respondent will consider the aforesaid Interlocutory Application filed by the petitioner and also report submitted by 3rd respondent and pass appropriate orders in accordance with law.

4. In view of the aforesaid discussion, this writ petition is disposed of directing 2nd respondent to consider the Interlocutory Application filed by the petitioner in File No.J/1332/2018 requesting 2nd respondent to bring the petitioner on record as sole legal heir of deceased Donthi Balamma and pass appropriate orders strictly in accordance with law by putting the petitioner and respondent Nos.2 to 25 in the said application on notice and affording them an opportunity of hearing. He shall complete the said exercise within three (3) weeks from the date of receipt of a copy of this order.

Consequently, miscellaneous Petitions, if any, pending, shall also stand closed.
