THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3146 OF 2017 ORDER:

This criminal petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioner/A.1 to enlarge him on bail in Crime No.94 of 2016 of Yeleswaram Police Station, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act') in unnumbered N.D.P.S. case pending on the file of I Additional District and Sessions Judge-cum-Special Court for the trial of NDPS cases, East Godavari at Rajamahendravaram. He is in judicial custody since 19.07.2016.

Sri Duvvuri Surya Narayana, learned counsel for the petitioner, while arguing the matter for some time, requested this court to direct the I Additional Sessions Judge, East Godavari at Rajamahendravaram, to try and decide the matter in accordance with law within a time frame. In view of the request made by the counsel for the petitioners, without touching any merits of the case, on account of dismissal of earlier Crl.P.No.1092 of 2017, I deem it appropriate to direct the I Additional Sessions Judge, East Godavari at Rajamahendravaram, to try and decide un-numbered NDPS S.C. in Crime No.94 of 2016 of Yeleswaram Police Station, in accordance with law, within three months from the date of receipt of a copy of this order.
