Ravi Kumar The Court made the following:JUDGMENT: This Civil Miscellaneous Appeal arises out of order, dated 31.12.2014, in I.A.No.158 of 2014 in A.S.No.52 of 2014 on the file of the X Additional District Judge, Gurazala. I have heard Sri M.Adam, learned counsel for the appellant and Sri E.V.V.S.Ravi Kumar, learned counsel for respondent No.1. Respondent No.1 filed O.S.No.141 of 2009 on the file of the Principal Junior Civil Judge, Gurazala, for perpetual injunction against the appellants and respondent No.2. It is her pleaded case that the suit schedule property originally belongs to one Ganipally Krupaiah; that he died leaving behind herself, one son and another daughter; that after the demise of the plaintiff's father, herself, her sister and brother partitioned the properties by executing a partition deed, dated 15.09.
2008; that as per the partition list, the suit schedule property fell to her share and since then she has been enjoying the said property and her name was mutated in the revenue records; that the appellants are in no way concerned with the suit schedule property; and that they are trying to dispossess her. In support of her plea, she has examined herself as P.W-1 and filed Exs.A1 and A-2 which are land revenue receipts, dated 09.07.2009 for fasli years 1409 to 1411, 1414 to 1417 and 1418, respectively. It is the case of the appellants-defendants that the suit schedule property originally belonged to the Government and in respect of the said land, DKT patta was issued to their father Ganipally Daveedu and that after the death of their father, they have succeeded to the said property. They have denied the claim of respondent No.
1-plaintiff that she has succeeded to the suit schedule property. The Court below, based on oral and documentary evidence, held that respondent No.1 failed to prove her possession over the suit schedule property. Referring to Exs.A-1 and A-2-receipts, the lower appellate Court has rendered a categorical finding that the said receipts were obtained in the name of respondent No.1 by paying land revenue on behalf of Daveedu, who is no other than the father of the appellants. As respondent No.1 failed to prove her possession, the trial Court dismissed the suit. Feeling aggrieved by the said order, respondent No.1 filed AS.No.52 of 2014 and in that appeal, she has filed I.A.No.158 of 2014 for ad interim injunction. By order, dated 31.122014, the lower appellate Court has granted the injunction order.
From a perusal of the order of the lower appellate Court, it is clear that the only basis on which it has granted injunction was Exs.A-1 and A-2, which are tax receipts showing Daveedu as the owner and possessor of the suit schedule property. The lower appellate Court has committed a serious error in relying upon these receipts without discussing their contents. When the trial Court has discarded these receipts by assigning cogent reasons, a duty is cast on the lower appellate Court to deal with the contents of these receipts if it intends to rely upon these documents. It is not in dispute that Exs.A-1 and A-2-receipts were obtained by respondent No.1 by paying tax in the name of Daveedu, who is the father of the appellants and through whom they claimed to have succeeded to the suit schedule property.
As rightly opined by the trial Court, they do not per se prove possession of respondent No.1-plaintiff. I am, therefore, of the opinion that the lower appellate Court committed a serious error in granting injunction in favour of respondent No.1 based on Exs.A-1 and A-2. As no other documents were filed showing possession of respondent No1, she is not entitled to grant of injunction. For the above-mentioned reasons, the order under appeal is set aside and the appeal is allowed. It is, however, made clear that the observations in this order shall not affect the pending appeal, which shall be disposed of by the lower appellate Court on its own merits. As a sequel to disposal of the Civil Miscellaneous Appeal, CMAMP.No.376 of 2015 filed by the appellants for interim injunction is disposed of as infructuous.
