THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.1184 OF 2024 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 to 6 seeking bail in the event of their arrest in connection with Crime No.332 of 2023 on the file of LMD Colony, Karimnagar District, registered for the offences under Sections 290 and 326 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

On 12.10.2023, a complaint was filed against these petitioners alleging that these petitioners have attacked the victim when there was quarrel with regard to installation of agricultural water pipe.

It appears that there are disputes in respect of installation of water pipe.

In the said circumstances, these petitioners can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos. 1 to 6 are directed to surrender before the Station House Officer, LMD Colony Police Station, Karimnagar District, on or before 09.02.2024. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 to 6 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioner Nos.1, 3 and 5 shall appear before the concerned Station House Officer for the purpose of investigation at 10:00 a.m. for a period of four weeks and thereafter, as and when required. Insofar as petitioner Nos.2, 4 and 6 are concerned, they shall appear as and when required.

3) The petitioners/accused Nos.1 to 6 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
