.....Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ order or direction in the nature of writ of certiorari calling for the records relating to remand report pursuance of the Police Station Enkoor, Khammam District CD dated 15.01.2013 filed in FIR No.6/2013 Dated 12.01.2013 registered under 420, 424, 343, 384, 506 r/w 34 IPC on the file of PS Enkoor on the file of Hon'ble Court of I Addl. JFCM, Kothagudem as arbitrary, illegal, malafide and void and without jurisdiction and does not constitute any offence and issue consequential direction directing to quash the same.

The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri P.V. Krishnaiah, Advocate for the Petitioner, and GP for Home for Respondent Nos.1 to 4, the Court made the following ORDER:

Learned Government Pleader for Home seeks time to obtain instructions from the 4th respondent. Since serious allegations are levelled, among others, on the police officials of Enkoor police station, the Sub Inspector of Police as also the Assistant Superintendent of Police, I consider it appropriate to direct the 4th respondent to cause an enquiry and submit a report to this Court whether the police officials of Enkoor police station have jurisdiction to investigate the complaint relating to the incidents alleged to have taken place at Hyderabad. While the investigation may go on, the petitioner (a lady belonging to the Scheduled Caste) shall not be arrested for a period of 10 days.
