THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 13155 OF 2015 O R D E R:

The petitioner herein mounted a challenge to the notification issued by the 3rd respondent Project Director on 01.04.2015, inviting applications from eligible persons to be appointed as Field Assistants. The grievance of the petitioner is that he was working as a Field Assistant of Amanam Gram Panchayat of Bheemunipatnam Mandal, Visakhapatnam District and without terminating his employment and also without settling the wages payable to him, the impugned notification has been issued proposing to fill up the very same post held by him. Hence, this Writ Petition.

Sri M.S.R. Chandra Murthy, learned Standing Counsel, who has accepted notice on behalf of Respondents 3 and 4, has secured instructions and he would submit that the services of the petitioner as a Field Assistant have been terminated by proceedings No.

165/2013/HR, dated 29.06.2013.

When once a Field Assistant's services have been terminated, he cannot have any locus to challenge the notification issued for filling up the vacancy thus caused. Therefore, it is open to the petitioner to work out the remedies available to him against the orders of termination of his engagement.

This Writ Petition is accordingly, dismissed at the admission stage. No costs.

Consequently, the miscellaneous applications, if any shall also stand dismissed.
