This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is A3, on bail in Crime No.21 of 2017 on the file of Rolugunta Police Station, Visakhapatnam District. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, the contraband involved in this case is 585 Kgs of Ganja from the truck. 4.

Learned counsel for the petitioner submits that the accused is got apprehended on the spot and based on the confession of the co accused, he was arrested. 5.

A perusal of the confession shows that this petitioner was travelling in the vehicle along with the other accused and absconded on seeing the police. Hence, the petitioner also stands on the same footing as that of the other accused. 6.

In the light of the above, this court opines that this is not a fit case for granting bail to the petitioner. Accordingly, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
