THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.1157 of 2017 ORDER:
This writ petition is filed seeking to declare the action of the respondents in seeking to evict the petitioner from his land to an extent of Ac. 0.10 cents, situated in Survey No.85 of Addateegala Village and Mandal, East Godavari District, without issuing any notice or passing any order, as illegal and arbitrary and consequently to direct the respondents not to evict the petitioner from the land mentioned above. Heard and perused the material available on record. The case of the petitioner is that the petitioner is Scheduled Tribe belonging to Valmiki Community and that the petitioner purchased land from one Balija Latchi Reddy, admeasuring to an extent of Ac. 0.10 cents, situated in Survey No.
85 of Addateegala Village and Mandal, East Godavari District and that from the date of purchase, the petitioner is in peaceful possession and enjoyment of the subject land. The main grievance of the petitioner is that respondents 2 & 3, at the instance of the 4th respondent, are interfering with the subject land of the petitioner and they are trying to evict the petitioner from the above said land, without following any due process of law and that neither any notice nor any proceedings are initiated under the Land Transfer Regulations.
Considering the said facts and circumstances, respondents 2 & 3 are directed not to interfere in the land to an extent of Ac. 0.10 cents, situated in Survey No.85 of Addateegala Village and Mandal, East Godavari District, belonging to the petitioner and that respondents 2 & 3 are directed not to dispossess the petitioner from the subject land,
without following any due process of law, if the petitioner is in possession of the subject land.
With the above directions, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
