CVNR,J & MSKJ,J ORDER: (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) Detention of one Bhoopathi Kirubakaran @ Krupakaran @ Kiruba, vide order dated 5-12-2016 in REV-CSEC0PDL(PRC)/2/2016-D.TH(C7), of respondent No.3 under Section 3 of A.P. Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act 1986, is assailed in this Writ Petition.

The main ground of challenge to the impugned detention order is that except the order and the grounds of detention, all the material based on which the detention order was passed, was not furnished to the detenu in Tamil which is the only language known to him. The learned Special Government Pleader representing the learned Advocate-General (AP) fairly conceded that the material forming the basis for detention of the detenu except the order and the grounds of detention, was not supplied to the detenu in Tamil language known to the detenu. In the light of the above, the detention order cannot be sustained and the same is set-aside. The Writ Petition is accordingly allowed. As a sequel to the disposal of the Writ Petition, WPMP No.3093 of 2017 filed for interim relief is disposed of as infructuous. ________________________ Justice C.V.
