This petition is filed for grant of anticipatory bail to the petitioner, who is A3 in Crime No.854 of 201 on the file of Vanasthalipuram Police Station, Rachakonda District.
The offences alleged are under Sections 148, 307, 342 read with Section 149 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The Public Prosecutor brings to the notice of this Court that the earlier bail petition which was filed by the petitioner was dismissed by this Court vide order dated 22.12.2017 in Crl.P.No.12476 of 2017.

A perusal of the order shows that the said petition was dismissed after considering the merits of the case and also on the finding that the allegations require thorough investigation and recoveries need to be made.

The Public Prosecutor submits that the recoveries are yet to be made from the petitioners.

Counsel for the petitioner submits that the other accused were enlarged on bail. But this petition is for anticipatory bail. 7.
Considering the facts and circumstances of the case, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of
the petitioner on merits and in accordance with law on the same day subject to the regular pressure of work.

With the above observation, the Criminal Petition is dismissed.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
