THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.719 of 2008 ORDER:

This writ petition was filed challenging the opening of rowdy sheet against the petitioner by the respondents 2 to 4. A counter affidavit is filed by respondent No.4, who is the Inspector of Police, Chatrinaka Police Station, Hyderabad stating that the petitioner was involved in five cases, out of which one case ended in acquittal, in one case action was dropped, one case was referred as 'false' and in one case he was bound over for good behaviour. However, in Crime No.66 of 2006 the trial is pending as the Non-bailable Warrant is pending against the petitioner. In view of the involvement of the petitioner in five cases, the Station House Officer, Chatrinaka Police Station, Hyderabad, submitted a report on 25.09.2006 to the Assistant Commissioner of Police, Falaknuma Division, Hyderabad, seeking permission for opening of rowdy sheet against the petitioner and permission was accorded on 29.09.2006. It is also stated that in Crime No.66 of 2006 the petitioner is not cooperating and the Non-bailable warrant could not be executed against him.

In view of the pendency of a lone case in Crime No.66 of 2006, this writ petition is disposed of by directing respondent No.3 to review the continuation of rowdy sheet opened against the petitioner and pass appropriate orders in accordance with law within sixty (60) days from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
