When the matter was listed before this Court on 06.11.2018, a representation was made on behalf of the respondent that the matter is settled out of Court, however, since there was no representation on behalf of the petitioner, the matter was directed to be listed under the caption 'for dismissal' on 09.11.2018, on which date also, there was no representation for the petitioner. Even today, there is no representation on behalf of the petitioner.

In those circumstances, it is presumed that the petitioner does not desire to prosecute the matter.
