This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.327 of 2017 on the file of Lalapet Police Station, Guntur Urban District. The offences alleged are under Section 420 r/ w 34 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that as per the complaint, the de facto complainant supplied 1180 quintals of Bengal Gram and this petitioner and other accused are due, amounts to the de facto complainant, but they are not paying the said amounts. The counsel further submits that this petitioner filed an IP subsequently.

From the facts, it, prima facie, appears that the petitioner had an element of cheating in his mind while entering into the transaction. Hence, this Court opines that this is not a fit case for granting anticipatory bail.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, on merits, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
