THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.35600 OF 2015 O R D E R :

This Writ Petition has been filed challenging the Notification No.C/7354/2013, dt.17.10.2015 issued by the 3rd respondent for bifurcating the ration cards of fair price shop No.2 at Utlapally Village, Kandukur Mandal, Ranga Reddy District of which petitioner is a dealer.

2. The learned Government Pleader appearing for 1st respondent has produced before me a proceeding CCS Ref.No.PP1/1418/2015, dt.27.10.2015 of the Commissioner of Civil Supplies, Telangana State, Hyderabad stating that action for appointment of fair price shop dealers would be kept in abeyance until further instructions. He contended that in view of the said proceedings, the cause in the writ petition no longer survives for adjudication, since the bifurcation of the fair price shop, of which the petitioner is a dealer, will not be done until further instructions and it would be kept in abeyance.

3. In view of this statement, the Writ Petition is dismissed as infructuous. However in case the proposal to bifurcate the ration cards from the fair price shop of which the petitioner is a dealer is again proceed with, the petitioner will be at liberty to approach this Court and assail the same. There shall be no order as to costs.

4. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
