SMT JUSTICE T.RAJANI CRIMINAL PETITION No.757 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.1, in Crime No.4 of 2018 on the file of the Station House Officer, Manopad Police Station, Jogulamba (Mahaboobnagar) District. The offences alleged are under Sections 409 and 420 R/w.34 of I.P.C.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

As per the case of the prosecution, it is accused No.6 who got enrolled herself as beneficiary under the "KCR Kit Programme", being given to the pregnant women, with an intention to encourage them to go to Government Hospitals for delivery.

Learned counsel for the petitioner submits that the petitioner herein is an innocent person and has been falsely implicated in this case. He further submits that accused No.2 in this case was already granted anticipatory bail and he is also entitled for bail as his case stands on the same footing as that of accused No.2. But, accused No.2 is a Staff Nurse in the hospital, where allegedly the said manipulations had taken place. But the petitioner herein is the Doctor. Hence, the submission of the petitioner's counsel that his case stands on the same footing as that of accused No.2, and that he is not responsible, and that he is not in know of the events happening in his Hospital and as such accused Nos.3 to 5 are also liable for the said manipulations, cannot be appreciated.

Hence, considering the above, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner/accused No.1 is at liberty to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work. Accordingly, with the above observation, this Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
