ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.633 of 2025 before the Kollur Police Station,

Cyberabad Commissionerate, registered for the offence punishable under Sections 105 of BNS.

The brief facts of the case are that the de facto complainant reported that on 18.12.2025, his 19-year-old sister, a college student, was dropped at college by her father in the morning but was later found present in their allotted government flat at KCR Nagar, Kollur, under suspicious circumstances. When the father visited the flat around 12:30 hrs, he found the door latched from inside and heard his daughter's voice but received no response. After locking the flat from outside and coming down, the victim allegedly attempted to descend from the 8th floor balcony along with her boyfriend, who was present inside the flat. During the attempt, while the boyfriend was holding her hands, she slipped and fell from the 8th floor to the ground floor, sustaining fatal injuries. Despite CPR being administered by municipal staff, she succumbed to the injuries. On enquiry, it was revealed that the boyfriend was the petitioner. Based on the complaint, a case was registered under Section 105 BNS. 3.

Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged allegations and that there is no ingredient made out under Section 105 of the BNS. He further submitted that the ingredients itself show that both the petitioner and the victim attempted to escape from the 8th floor. He contended that the petitioner has been in judicial custody since 19.12.2025 and that the material part of the investigation has been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. He further submitted that the investigation is not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 19.12.2025. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 17 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Special Judicial Magistrate of First Class, Prohibition and Excise Offences, Sangareddy.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
