THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.2458 of 2016 ORDER:
This civil revision petition is filed by the petitioners under Article 227 of the Constitution of India aggrieved by the order dated 26.04.2016 in I.A.No.425 of 2016 in C.M.A.No.3 of 2016 on the file of the Court of XIII Additional District Judge, Narasaraopet, Guntur District.
Heard both the counsel.
A perusal of the record reveals that the respondents herein have filed O.S.No.224 of 2015 on the file of the Court of Additional Senior Civil Judge, Narasaraopet, against the petitioners herein for perpetual injunction. Along with the suit, the respondents herein filed I.A.No.362 of 2015 seeking ad-interim injunction. On 25.04.2016, the trial Court dismissed the I.A.No.362 of 2015. Feeling aggrieved by the orders dated 25.04.2016 in I.A.362 of 2015, the respondents herein preferred C.M.A.No.3 of 2016. Along with the CMA, they also filed I.A.No.424 of 2016 seeking ad-interim injunction. The appellate Court granted status quo on 26.04.2016 and the same was extended from time to time. Feeling aggrieved by the orders dated 26.04.2016, the present revision is filed. When the CMA is pending before the appellate Court, it is not fair on the part of this Court to express any opinion touching the merits of the main case. If this Court expresses any opinion touching the merits of the main case, the same may cause
prejudice to one of the parties to the proceedings. More over, the appellate Court granted only status quo.
Having regard to the facts and circumstances of the case, the Additional District Judge, Narasaraopet, is hereby directed to dispose of C.M.A.No.3 of 2016 as expeditiously as possible, preferably, within one month from the date of receipt of copy of this order.
With the above observation, Civil Revision Petition is disposed of. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
