THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19577 of 2016 ORDER :

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader Home for the State of Telangana.

2. The present Writ Petition is filed seeking the following relief :

"...to issue writ, order, direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents in harassing the petitioner's father on phone as illegal and arbitrary and consequently direct the respondents to cancel the LOC if it has been issued against the petitioner relating to C.C. No.13 of 2016 on the file of IXth Metropolitan Magistrate Court, Miyapur, Cyberabad, at Hyderabad and pass...

3. It is stated by both the counsel that the point involved in this Writ Petition is squarely covered by the order dated 06.03.2015 in Writ Petition No.3213 of 2015 passed by a learned single Judge of this Court, wherein it has been held as under:

".. Since no purpose would be served by directing the petitioner to approach the Superintendent of Police for the purpose of withdrawal of LOC, this Writ Petition is disposed of permitting the petitioner to move to Court of Special Judicial Magistrate of First

Class, Prohibition & Excise, Guntur, where C.C. No.570 of 2014 is pending and to make appropriate application seeking withdrawal of LOC. The petitioner is also at liberty to set out the reasons for making the said request including that he has already surrendered and has been abiding with the directions issued from time to time by the Court. If such an application is made by the petitioner, the learned Special Judicial Magistrate of First Class shall consider the same in accordance with law and pass appropriate orders expeditiously. .."

Following the same, this Writ Petition is disposed of, in terms of the said order giving liberty to the petitioner to move an application before the appropriate Court for withdrawal of the LOC. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
