THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.331 of 2015 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioner/Accused in C.C.No.388 of 2014 on the file of the Court of learned Judicial Magistrate of First Class, Godavarikhani, cognizance taken for the offences under Sections 454 and 380 of I.P.C. praying to quash the proceedings in the said case.

2. Heard the learned counsel for the petitioner/Accused so also the learned Public Prosecutor representing State-1st respondent before admission and perused the material on record.

3. The Criminal Petition is disposed of without prejudice to the rights of the parties in the pending criminal case i.e.C.C.No.388 of 2014 on the file of the trial Court, by directing the Civil Supplies Officer to verify the condition of the Paddy and assess the present value in the presence of the petitioner and release the same to him on his executing a personal bond for the said value. Consequence of the release order herein is subject to the ultimate result of C.C.No.388 of 2014. Consequently, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
