HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10050 of 2015 ORDER :

This Criminal Petition is filed by the petitioners under Section 482 Cr.P.C seeking to quash the order dated 11.09.2015 in M.C. No.5 of 2015 on the file of Sub-Divisional Magistrate and Revenue Divisional Officer, Vizianagaram.

2) Heard the learned counsel for the petitioners and the learned Public Prosecutor for the State.

3) Perused the material on record. The facts fall short for this Court to admit the application to quash the proceedings initiated under Section 111 Cr.P.C. Needless to say, the inquiry must be completed within six months as contemplated under Section 116(6) Cr.P.C. from the date of initiation of proceedings i.e., 11.09.2015.

4) Needless to say, if the petitioners file an application under Rule 37 of Criminal Rules of Practice for one to represent others, the learned Magistrate shall hear and permit the same with necessary conditions of personal appearance, as and when required.

5) Accordingly, this Criminal Petition is disposed

of. Miscellaneous petitions pending, if any, shall stand closed.
