The case of the petitioner is that he was working as Watchman in A.P.Social Welfare Residential School for Girls, G.V.Gudem and he was suspended on 05.09.2000 from service for nine months and was paid subsistence allowance. Thereafter, he was dismissed from service without conducting enquiry by the 1st respondent vide order dated 11.01.2001. Against the said dismissal order the petitioner filed WP.No.2597 of 2001 and in implementation of the orders passed by this Court in the said writ petition on 25.11.2010, the 1st respondent by his proceedings dated 26.07.2011 placed the petitioner under suspension on 26.07.2011 by cancelling the dismissal order. Thereafter the 1st respondent issued Articles of Charges through proceedings dated 20.09.2011 for which the petitioner submitted explanation on 21.05.2012.
Subsequently, the 1st respondent after conducting enquiry passed orders of dismissal on 19.10.2013. Against the said orders the petitioner filed appeal on 28.11.2013 and the same was rejected by the 2nd respondent vide proceedings dated 18.05.2017. Thereafter, the petitioner submitted two representations dated 06.09.2016 and 20.03.2017 before the 1st respondent claiming subsistence allowance from 11.01.2001 to 19.10.2013 as the 1st respondent by his proceedings dated 26.07.2011 ordered to keep the petitioner under suspension as per the final orders passed in WP.No.2597/2001 by cancelling the dismissal order. As the same is not being disposed of present writ petition is filed.
Heard learned counsel for the petitioner and Sri N.Bhupal Reddy, learned counsel appearing for respondents 1 and 2. Since the grievance of the petitioner is already pending by way of representations before the respondents, without expressing any opinion on merits, the 1st respondent is directed to consider the representations of the petitioner and take action in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
