HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2267 of 2018 ORAL ORDER: (Per Suresh Kumar Kait, J) Vide the present petition, petitioner has assailed the order dated 18.10.2017 passed in O.A.No.2851 of 2017 by the Andhra Pradesh Administrative Tribunal, whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985, was dismissed. 2.

We note, the learned Tribunal has come to the conclusion that, when the petitioner has filed appeal before the 2nd respondent, who is the appellate authority against the order of removal dated 30.05.2017, the O.A., is not maintainable before the Tribunal.

After hearing learned counsel for the petitioner and the learned Government Pleader appearing on behalf of the respondents, we are of the considered opinion that interest of justice would be met if we direct respondent No.2 to decide the appeal dated 17.06.2017 filed by the petitioner against the order of removal dated 30.05.2017, within four weeks from the date of receipt of this order. Learned Government Pleader has assured this Court that the appeal shall be decided as per the directions of this Court. 4.

Petition is accordingly disposed of with the aforesaid directions. No order as to costs.

As a sequel, miscellaneous petitions, if any, pending in the petition, stand closed.
