THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.772 OF 2019 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused to quash the proceedings in Crime No.294 of 2018 of Reinbazar Police Station, Hyderabad City, registered for the offences punishable under Sections 420, 273 and 188 I.P.C.

Heard learned counsel for the petitioner/accused and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

Learned counsel for the petitioner/accused would contend that the allegation that the petitioner/accused was selling banned products, particularly tobacco, to the public is false; that there are no ingredients attracting the provisions under Sections 420, 273 and 188 I.P.C. and ultimately, prayed to allow the petition. 4.

It is pertinent to state that the subject crime is under investigation.

There is specific allegation that the petitioner/accused is selling banned products, particularly Tobacco, to the public. Under these circumstances, at this stage, it cannot be held that there are no grounds to proceed with the investigation with regard to alleged offences. 5.

Hence, the Criminal Petition is dismissed.

Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
