Learned counsel for the appellant would submit that suit in O.S.No.566 of 2003 on the file of Principal Junior Civil Judge, Karimnagar was decreed and against the same, an appeal is filed and is pending. In that view of the matter, the present Second Appeal does not lie and has become infructuous. On the said submission, the Second Appeal is dismissed as infructuous.

Consequently, miscellaneous petitions, pending, if any shall stand closed. No costs.
