THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27411 of 2007 ORDER:
This Writ Petition was filed challenging the inaction of the first respondent in passing any orders pursuant to the application dated 22.07.2005 made by the petitioner Society requesting to denotify under Rule 4(3) of the Andhra Pradesh (Prohibition of certain documents opposed to public policy) Rules, 1999, in respect of the land admeasuring Acs.73.00 situated in Survey No.222 of Gajularamaram Village, Qutbullapur Mandal, Ranga Reddy District.
This Court, by order dated 20.12.2007, directed the second respondent to receive the sale deed dated 01.10.2007 from the second petitioner.
A counter affidavit is filed stating that the Office of the Sub Registrar, Qutbullapur, was newly established with effect from 01.10.2007 by bifurcating the erstwhile Sub Registrar Office, Medchal. It is further stated that as on the date of filing the counter affidavit i.e., on 21.01.2008, no document was presented for registration in respect of the above land. Learned Counsel for the petitioners could not get instructions from his clients with regard to the subsequent developments.
In the circumstances, in view of the Full Bench decision of this Court in Vinjamuri Rajagopala Chary v. State of Andhra Pradesh1, it is open to the petitioners to submit a representation to the District Collector, if there is any grievance with regard to the above land, and as and when such a representation is received, the District Collector shall pass appropriate orders.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 27.07.2017 vs 1 2016 (2) ALD 236
