THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15605 OF 2017 O R D E R :

The case of the petitioner is that at the instance of the 5th respondent, Respondents 2 to 4 have been interfering with his peaceful possession and enjoyment over the car shed in 12' site which is part and parcel of his land situated in Survey No. 319/3 with Door No. 3/2/63 of Naidupet Village, SPSR Nellore District. Heard learned counsel for the petitioner.

Sri Mohd. Saleem, on instructions, submits that the allegations made by the petitioner are not correct and none of the authorities from the Municipality have visited the subject land and threatened the petitioner. If at all any action is to be taken, the same would be done by following the due procedure established by law.

The Writ Petition is therefore, disposed of recording the submission made on behalf of the 2nd respondent Municipality. It is also made clear that the petitioner, as a citizen, is entitled to protect himself from the unauthorized interference of the individuals, who claim to be the officials of Respondents 2 to 4, by taking recourse to law. In the event there is any interference with his possession and enjoyment over the subject property, the petitioner shall be entitled to initiate both civil and criminal proceedings. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
