HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.13082 OF 2017 ORDER:

The writ petition is filed challenging the action of the respondents in rejecting the application dated 13.07.2016, submitted by the petitioners for grant of permission for construction of residential buildings in Plot Nos. 39 and 39-A, Gopalnagar Society, situated in Sy.Nos.148 to 155, Balanagar Mandal, Ranga Reddy District. As can be seen from the common order dated 29.12.2016, passed by this Court in W.P.No.18316 of 2008 and batch, G.O.Ms.No.985 Revenue-UCI Department dated 02.08.2008, was set aside. Further, at the relevant point of time, when W.P.No.18316 of 2008 and batch were pending, there was no dispute with respect to the title. However, consequent to the pronouncement of the orders in W.P.No.18316 of 2008 and batch setting aside the G.O.Ms.No.985 Revenue-UCI Department dated 2.8.2008, the applications of the petitioners are required to be reconsidered.

In those circumstances, the writ petition is allowed setting aside the impugned rejection order of the respondents with a direction to the respondent authorities to consider the applications of the petitioners afresh and process the same by taking into consideration of the subsequent developments and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of copy of the order. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
