THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2733 of 2019 O R D E R:

Petitioner asserts that he is the owner of house plot bearing No.4-2-62/B, admeasuring 115.55 square yards, situated at Mahboobabad Town and Mandal, Warangal District by virtue of Gift Settlement Deed, dated 19.11.2012, and that the respondent authorities are threatening to demolish the compound wall without issuing any notice.

Learned Standing Counsel for respondent No.2 submits that the allegations made in the writ affidavit are not true and that as the property, which the petitioner is in occupation, belongs to the Municipality, which left the same as open space, necessary action would be taken by following due process of law. Recording the above said submission, the writ petition is closed by making it clear if any action is to be taken with respect to the property in question, which is, admittedly, in occupation of the petitioner, the respondent authorities shall follow the procedure prescribed in law.
