Kotapalli Varmappa, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.13272 of 2015 ORDER:
Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies (Andhra Pradesh).
This writ petition is filed seeking a writ of mandamus declaring the action of the 2nd respondent in suspending the authorisation of the petitioner vide proceedings dated 10.04.2015 without mentioning the period of suspension, as illegal and arbitrary.
Learned counsel appearing for the petitioner submits that all the charges are general and vague in nature, and therefore, the authorisation ought not to have been suspended by the order impugned.
On the other hand, learned Assistant Government Pleader submits that, in all, six charges have been framed against the petitioner, which require enquiry. Since the order challenged is an order of suspension pending enquiry, the Revenue Divisional Officer, Kadiri, the 2nd respondent herein, is directed to conduct enquiry and pass final orders within a period of two (2) months from the date of receipt of a copy of this order, failing which, the authorisation of the petitioner shall stand restored.
The writ petition is accordingly disposed of. No order as to costs. The miscellaneous petitions pending, if any, shall stand closed. ________________ R.KANTHA RAO, J Date: 30.04.2015 GJ
