HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 2832 of 2019 ORDER: (per V. Ramasubramanian, J)
1) The petitioner who has availed a housing loan has come up with the above writ petition challenging an order passed by the District Collector under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short " the Securitization Act" ).
2) Heard Mr.Aijal Ali Quraishi, learned counsel for the petitioner and Mr.A.Krishnamraju, learned Standing Counsel for the fourth respondent-bank.
3) The total amount due as per the impugned order is Rs.6,24,815/ - as on 31.05.2018. The loan in question is a housing loan. The petitioner has filed an affidavit before Court seeking only six weeks time to settle the dues. In the light of the above, the Writ Petition is disposed of granting six weeks time to the petitioner from the date of receipt of a copy of the order for repayment of loan. If the petitioner fails to repay the amount then the respondent-bank may proceed in accordance with law. It is needless to point out that the remedies, if any open to the petitioner may also be availed at that time.
