HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.280 OF 2018 ORDER:
Heard the learned counsel for the petitioner. Having regard to the facts involved in this matter, this court is of the considered view that this Criminal Revision Case is disposed of at the admission stage without the necessity of affording notice to the respondents.
This Criminal Revision Case is filed aggrieved by the order dated 17-11-2017 in CFR.No.824 of 2017 passed by the learned V Additional Junior Civil Judge, Guntur whereunder the learned judge dismissed the private complaint filed by the petitioner as there was no representation when the matter was called during the call work.
Learned counsel for the petitioner would submit that the counsel of the petitioner was engaged in another court when the matter was called and by the time he rushed to the court, the matter was already called and was dismissed and in those circumstances, there was no fault on the part of the petitioner and hence, an opportunity may be given to the petitioner to present his case before the lower court.
Having regard to the above circumstances, the impugned docket order dated 17-11-2017 is set aside and the petitioner is directed to appear before the trial court on 21-2-2018 and the trial
court shall hear the matter with regard to the objections taken by the office of the trial court and pass necessary orders on merits. Accordingly, this Criminal Revision Case is disposed of. As a sequel, miscellaneous applications pending if any, shall stand closed.
