HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 15117 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Home.
The grievance of the petitioner is that the fourth respondent is interfering with the life of the petitioner by calling him to the police station regularly and threatening him to surrender along with his car bearing No.AP 29 BP 1439, without registering any case against him.
The Government Pleader for Home submits that the police have registered a case in Crime No.60 of 2015 of Madugula Police Station for the offences punishable under Sections 379, 511 and 506 IPC and during the course of investigation in the said crime the police might have summoned the petitioner, but however denied the allegations of harassment made in the affidavit filed in support of the writ petition. Having regard to the facts and circumstances of the case and in view of the representation made by the Government Pleader for Home, there shall be a direction to the police authorities not to interfere with the life and liberty of the petitioner unless his examination/interrogation is warranted in relation to any criminal investigation and even if so, they shall strictly abide by the procedure laid down in this regard in the Code of Criminal Procedure, 1973.
With the above direction, the Writ Petition is disposed of.
No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
